Welcome to Mackie Mobile. These terms are designed to be clear and fair. We built our service on respect for our customers, and that starts with transparent terms you can actually understand.
By using Mackie Mobile's services, you agree to these Terms and Conditions. Please read them carefully. If you have any questions, we're here to help.
1. Our Service Agreement
1.1 What We Provide
Mackie Mobile provides secure, privacy-focused wireless telecommunications services. We offer both prepaid service plans (pay-as-you-go) and monthly subscription plans. All plans include access to our network, customer support, and our privacy protection commitments outlined in our Privacy Policy.
1.2 Eligibility
To use our service, you must be at least 18 years of age or have parental/guardian consent. You agree to provide accurate information during registration and to keep your account information current.
1.3 Your Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Compliance with all applicable laws and regulations
- Using the service in accordance with our Acceptable Use Policy
- Payment for services rendered
2. Service Plans and Billing
2.1 Prepaid Service
Our prepaid plans require payment in advance for service. Your service will remain active as long as you maintain a positive balance or active plan. Prepaid service does not automatically renew unless you enable auto-refill.
2.2 Monthly Subscription Service
Monthly subscription plans automatically renew each billing cycle unless you cancel before the renewal date. You authorize us to charge your payment method on file for recurring charges.
2.3 Payment and Billing
- Payment Methods: We accept major credit cards, debit cards, and other payment methods as displayed during checkout.
- Automatic Payments: For subscription plans, you authorize recurring charges. You can cancel at any time before the next billing cycle.
- Billing Disputes: If you believe you were charged incorrectly, please contact us within 60 days of the charge. We will investigate and resolve the issue promptly.
- Price Changes: We reserve the right to adjust our prices. For subscription customers, we will provide at least 30 days' notice before any price increase takes effect.
2.4 Taxes and Fees
Your total charges may include applicable federal, state, and local taxes, as well as regulatory fees required by law. These will be clearly itemized on your invoice.
3. Service Terms
3.1 Network Coverage
We provide service over our partner networks. While we strive for consistent coverage and quality, wireless service can be affected by various factors including terrain, weather, network capacity, and distance from cell towers. We do not guarantee uninterrupted service or coverage in all locations.
3.2 Fair Use and Network Management
We do not throttle your data or deprioritize your traffic under normal circumstances. However, we reserve the right to implement reasonable network management practices to prevent network abuse and ensure quality service for all customers. This includes:
- Protection against malicious traffic and security threats
- Prevention of network congestion from excessive or abusive use
- Compliance with legal obligations
Important: We define excessive or abusive use as activity that significantly impairs network performance for other customers or violates our Acceptable Use Policy. Normal, everyday use—even heavy use—is not restricted.
3.3 International Services
International calling, texting, and roaming may be available depending on your plan. Additional charges may apply. Please review your specific plan details or contact us for international service information.
4. Device and Equipment
4.1 Compatible Devices
You are responsible for providing a compatible device for use with our service. We will clearly communicate device compatibility requirements. Not all devices are compatible with our network.
4.2 Device Unlocking
If you purchase a device from us, it may be locked to our network initially. We will unlock devices upon request once all financial obligations are met and after a reasonable period of active service (typically 60 days for prepaid, immediately for fully paid subscription plans).
4.3 Bring Your Own Device
You may bring your own compatible device to our service. You are responsible for ensuring your device is unlocked, compatible, and properly configured.
5. Privacy and Data Protection
Your privacy is fundamental to our service. We will NEVER sell, rent, lease, or monetize your personal data. We do not share your information with third parties for marketing purposes. Please review our Privacy Policy for complete details on how we protect your information.
6. Cancellation and Refunds
6.1 Your Right to Cancel
Subscription Plans: You may cancel your subscription at any time. Your service will remain active until the end of your current billing cycle. No refunds are provided for partial billing periods, but you will not be charged for subsequent periods.
Prepaid Service: Prepaid service can be discontinued at any time. Unused prepaid balances may be non-refundable except as required by law. Please review specific plan terms.
6.2 Cooling-Off Period
If you are not satisfied with our service, you may cancel within 7 days of activation for a full refund of service charges paid (excluding any device purchases, which are subject to separate return policies).
6.3 Service Termination by Mackie Mobile
We reserve the right to suspend or terminate your service if:
- You violate these Terms and Conditions
- You fail to pay for services when due
- You engage in fraudulent activity
- You use the service in a way that harms our network or other customers
- You violate our Acceptable Use Policy
We will provide reasonable notice before termination unless immediate action is required to protect our network or comply with legal obligations.
7. Acceptable Use Policy
You agree not to use our service to:
- Engage in illegal activities
- Send spam, unsolicited communications, or fraudulent messages
- Harass, threaten, or harm others
- Infringe on intellectual property rights
- Distribute malware, viruses, or malicious code
- Interfere with or disrupt our network or services
- Attempt unauthorized access to our systems or other users' accounts
- Resell service without our written authorization
- Use automated systems (bots) for abusive purposes
8. Limitation of Liability
8.1 Service Interruptions
Wireless service can be affected by many factors outside our control. While we strive for reliable service, we do not guarantee uninterrupted or error-free service. We are not liable for service interruptions, network outages, or degraded service quality due to factors beyond our reasonable control.
8.2 Limitation of Damages
To the maximum extent permitted by law, Mackie Mobile's total liability for any claim related to our service is limited to the amount you paid for service in the three months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
8.3 No Liability for Third-Party Content
We are not responsible for content accessed through our network, including websites, applications, or communications from third parties.
9. Emergency Services (911)
Critical Information: Our service supports 911 emergency calling. However, 911 service may not function during network outages, if your device is out of battery, or in areas without coverage. Always ensure you have an alternative method to reach emergency services.
You agree to inform all users of your service about the limitations of wireless 911 services.
10. Intellectual Property
All content, trademarks, logos, and intellectual property associated with Mackie Mobile remain our exclusive property or that of our licensors. You may not use our intellectual property without written permission.
11. Dispute Resolution
11.1 Customer Service First
We are committed to resolving issues fairly and quickly. If you have a concern, please contact our customer service team first. We will work in good faith to address your concerns.
11.2 Informal Resolution
Before pursuing any formal dispute resolution, you agree to contact us to attempt to resolve the issue informally. Many concerns can be resolved through conversation.
11.3 Arbitration Agreement
Any disputes that cannot be resolved informally will be resolved through binding arbitration rather than in court, except where prohibited by law. Either party may bring claims in small claims court if they qualify.
Arbitration will be conducted by a neutral arbitrator in accordance with applicable arbitration rules. Each party will bear their own costs, and the arbitrator may award costs to the prevailing party as permitted by law.
11.4 Class Action Waiver
You agree that disputes will be resolved on an individual basis. You waive any right to bring claims as a class action or participate in class action lawsuits, except where such waivers are prohibited by law.
12. Governing Law
These Terms and Conditions are governed by the laws of the State of Florida and applicable federal laws, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. Material changes will be communicated to you via email or account notification at least 30 days before they take effect. Continued use of our service after changes take effect constitutes acceptance of the new terms.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any plan-specific terms, constitute the entire agreement between you and Mackie Mobile regarding our service.
